Humanitarian residency permit

The Commanding Officer of the Border Guard is also authorised to issue humanitarian residency permits authorising foreigners to stay in the Republic of Poland, if an obligation to return:

– obligates them to return solely to a country where, pursuant to the European Convention for the Protection of Human Rights and Fundamental Freedoms drafted in Rome on 1950 their life, freedom and personal safety would be at risk, or they might be subjected to tortures, inhumane or humiliating treatment or punishment, forced to labour or
deprived of their right to a fair trial or subjected to punishment without a legal basis, or

-infringes with their family or private life pursuant to the European Convention for the Protection of Human Rights and Fundamental Freedoms drafted in Rome on 1950, or

-violates children’s rights defined in the UN Convention on the Rights of the Child of 20 November 1989 to the extent substantially endangering their psychological and physical development.
