Subsidiary protection awarded to foreigners

A foreign national who has not fulfilled all conditions required in order to obtain a refugee status may still apply for subsidiary protection.

Pursuant to the Act on Granting Protection to Foreign Nationals in the Republic of Poland of 13 June 2003, a foreign national may obtain subsidiary protection and be allowed to stay in Poland if returning to his/her home country would involve a risk of serious harm such as:

-being sentenced to death penalty, or execution;
-being subjected to tortures, inhuman or humiliating practices or penalties;
-being at risk of losing his/her life or health as a result of general use of violence against civilians as a result of international or internal armed conflicts.
